Vivida Client Booking Terms & Conditions

1. Booking & Deposit

To confirm your place on a Vivida tour, a 30% deposit is required at the time of booking. This is the first of three payments totalling the full tour price (see Section 2 for payment schedule).

This deposit is fully refundable for 7 days from the date of payment, for any reason. After 7 days, Vivida begins incurring supplier and administrative costs and the deposit becomes non-refundable.

All prices are quoted in AUD and inclusive of GST, where applicable.

2. Payment Schedule

  • Deposit (30%): due at the time of booking
  • Progress Payment (30%): due 180 days before departure, or upon booking if within that window
  • Final Balance (40%): due 90 days before departure, or upon booking if within that window

Payments can be made by direct bank transfer or other methods offered at the time of booking such as credit card (please note, credit card payments will attract a surcharge). You will receive a confirmation and tax invoice upon payment.

If payment is not received by the due date, Vivida reserves the right to cancel the booking and retain any non-refundable amounts paid to date.

3. Cancellation Policy

Vivida requires all travellers to obtain travel insurance to protect against unplanned circumstances that may lead to cancellation.

If you choose to cancel:

  • Within 7 days of the deposit payment: Your deposit and any further payments will be refunded in full
  • After 7 days and 100+ days before departure: 30% deposit is non-refundable. All additional payments will be refunded
  • 0–99 days before departure: No refund will be provided. If a booking is made within this period, full payment is due at the time of booking and becomes non-refundable

Where possible, Vivida may offer the option to transfer your booking to a future tour of equal value, subject to operational feasibility.

If Vivida cancels a tour due to unforeseen circumstances (e.g. minimum numbers not met, host unavailability etc.), you will receive a full refund or the option to transfer your booking to a future tour of equal value.

4. Changes to Bookings

You may request to transfer your booking to another tour up to 100 days before departure, subject to availability. A change fee may apply to cover any non-refundable supplier arrangements.

Name transfers are not permitted without Vivida's written consent.

5. What's Included

As per the itinerary, your tour includes:

  • Accommodation with private room (no single supplement)
  • Daily breakfast and meals indicated as included in the itinerary
  • Ground transport via private minibus
  • Guided cultural experiences, tastings, and entry fees for all activities outlined in the itinerary
  • Personal hosting by Vivida's founder for the duration of the tour
  • Space for up to 32kg of luggage per guest

Every effort will be made to accommodate pre-disclosed dietary and mobility needs, however this cannot be guaranteed unilaterally by Vivida.

There is no entitlement for any refund or reimbursement from Vivida if a guest does not use, or participate in, the tour inclusions.

6. Exclusions

Unless stated otherwise, your tour price does not include:

  • Airfare or transport to and from the starting/ending destination
  • Travel insurance (required as per Section 7 below)
  • Passport and visa fees
  • Meals or drinks not listed in the itinerary
  • Optional activities, whether listed on the itinerary or not
  • Personal expenses
  • Tips and gratuities

7. Travel Insurance

Comprehensive travel insurance is mandatory for all Vivida guests. It must cover trip cancellation, medical emergencies, personal liability, and evacuation.

Proof of insurance is required no later than 30 days before departure.
Failure to provide proof of insurance may result in cancellation of your booking without refund.

It is your responsibility to make an informed decision about travel, including being aware of official advice (e.g. smartraveller.gov.au). Vivida can provide general guidance but does not accept liability for illness, delays, or other disruptions arising from travel risks or government advisories.

8. Visa Responsibility

It is your responsibility to ensure that your passport and visa(s) meet the entry requirements of the countries visited. Vivida can assist with guidance on requirements but does not accept liability for denied entry, travel disruptions, or additional costs due to visa issues.

9. Personal Conduct

Vivida tours are built around shared connection, respect, and inclusiveness. We ask all guests to behave in a considerate and respectful manner toward fellow travellers, local hosts, and guides.

Vivida reserves the right to remove any guest from a tour – without refund – if their behaviour is deemed:

  • Disruptive
  • Unsafe
  • Discriminatory
  • Contrary to the wellbeing of the group

This includes liability for any damage or loss caused, or any costs incurred as a result of their removal.

10. Replacement Host or Guide

All Vivida tours are designed and led by our founder. However, in the event that the founder is unable to accompany a tour due to illness, injury, or other unforeseen circumstances, Vivida reserves the right to appoint a qualified replacement host or guide.

This substitute will be carefully selected to maintain the tone, service quality, and guest experience that define Vivida.

The use of a replacement host does not constitute grounds for cancellation or refund, provided that the overall itinerary and inclusions remain materially unchanged.

11. Force Majeure

Vivida is not liable for cancellations or changes resulting from events beyond our control, including but not limited to:

  • Pandemics
  • Natural disasters
  • Political unrest
  • Government-imposed travel restrictions

In such cases, we will work with you to reschedule or refund as fairly as possible, while considering commitments already made to suppliers.

12. Australian Consumer Law

These terms operate alongside your rights under the Australian Consumer Law. Nothing in these terms excludes or limits your statutory entitlements.

The jurisdiction and law applicable to these Terms and Conditions are those of South Australia.

Vivida is responsible for providing booking and advisory services in accordance with these Terms and Conditions. These services are in addition to the Australian Consumer Law which guarantees that our services will be:

  • Provided with due care and skill
  • Fit for the specified purpose
  • Expected to achieve the desired result within a reasonable time

13. Acceptance of Booking Terms and Conditions

These Terms and Conditions are applicable to all bookings, whether made over the phone, by email, or online via the Vivida website.

Vivida relies on the person making the booking for the accuracy of all information provided. If the booking is being made for another individual, these Terms and Conditions apply to all travellers.

By confirming your booking with Vivida, you acknowledge that:

  • All information provided is true and correct
  • You have read, understood, and agree to be bound by these Terms and Conditions

These terms constitute the basis of your agreement with Vivida.
